NIO Training Terms and Conditions of Business
All course bookings must agree to our T&C’s

1. General Terms and Conditions
These Terms and Conditions set out shall apply to all work carried out in the provision of services by NIO Training Ltd to you as the customer together with the quote and/or sales order which has been agreed by the customer (company or individual). This agreement shall prevail over any marketing material, or electronic, written or oral representation made to you by NIO Training Ltd, it’s employees or representatives unless expressly agreed in writing by both parties and expressed to be an amendment to these Terms and Conditions.

2. Confirmation of booking
Upon receipt of payment and signed terms and conditions or valid purchase order, places on the training course are then reserved. Joining instructions and official booking confirmation will be sent prior to the course. Payments must be made prior to the course, please refer to clause 3 and 4 regarding payment. Please refer to clause 3 and 4 with regards to the customers liability for payment and any refunds by NIO Training Ltd when there is a cancellation. To confirm your booking NIO Training Ltd must receive the request in writing via an email and sent to contact@niotraining.com.

3. Payment
No booking is confirmed until receipt by NIO Training Ltd of the full payment. Payment is normally made at the same time of booking. Payment can be made over the phone by credit card or by BACS by agreement. In the event of a company booking, a PO will need to be raised at the time of booking an invoice paid 10 days prior to the training course. Prices charged will be determined on each course/assessment required at the time of booking. From time-to-time NIO Training might offer special prices or discounts. Such discounts are normally advertised on NIO Training Ltd website. No amendments to bookings will be made once bookings have been confirmed. NIO Training may agree to BACS payments, this will be by agreement only between the parties. Payment details will be provided on quotation.

4. Payment Terms
Payment is made in advance of the course for all non-account holders and for those without agreed terms. Please see cancellation terms in clause 5. All prices listed are exclusive of VAT which will be added at checkout. If payment is delayed by the customer, interest will be charged at 8% per day.

5. Cancellation and transfers
For all cancellations or delegate name changes they MUST be emailed to contact@niotraining.com.

Cancellations on the day
Cancellations or no shows on the day will incur the full fee payable. NIO Training Ltd will not make any refunds.
​
Cancellations within 10 days prior to the course
If a cancellation is received within 10 days prior to the course the customer is liable for the full payment. NIO Training Ltd will not make any refunds. However, the customer may make a name change up to 5 days prior to the course. This request must be in writing and sent to contact@niotraining.com. Only when NIO Training Ltd has confirmed name change, the booking is confirmed.

Cancellations within 10 to 15 days prior to the course
If the cancellation is received in writing to contact@niotraining.com between 10 to 15 days prior to the course, the customer is liable for 50% of the course fee. NIO Training Ltd will refund 50% of the course fee back if the payment has been made by the customer.

Cancellations made 16 days prior to the course
If the cancellation is made 16 days or more prior to the course, the customer will not be liable for the for the fee and if payment has been made, they will receive a refund of 100% of the course. Cancellations need to be in writing and sent to NIO Training Ltd at contact@niotraining.com.

Changes to bookings
NIO Training Ltd aim to run all the courses it advertises. Any changes to the course dates or times will be notified as soon as possible. NIO Training Ltd reserves the right to change or cancel courses and accept no consequential liability (including but not limited to economic loss, loss of profit, loss of business opportunities or loss of revenue or any other claim irrespective of notice given for any changes made by NIO Training Ltd).

6. Data Protection
NIO Training Ltd has a strict policy to keep personal information supplied for the purposes of providing the service. NIO Training Ltd may from time to time send you information about courses, services or products and special offers. If you would prefer not to receive this information, please email contact@niotraining.com. NIO Training Ltd will not pass on details to a third party without prior permission.

7. Course Documentation
Course notes and handouts serve as a reference guide for use after the event. They must not be copied or cascaded for training purposes. All literature is covered by copyright. Reproduction of handouts and course notes is not permitted without express permission from NIO Training Ltd. All Intellectual Property Rights in or arising out of or in connection with the service provided by NIO Training Ltd shall be owned by NIO Training Ltd.

8. Times and Course Descriptions
Full details of the course with start and finish times and full course details will be sent to delegate upon booking confirmation. Joining instructions will be sent prior to the start of the course. NIO Training Ltd reserves the right not to allow late arrivals to enter the course. In these circumstances the customer is liable for the full payment of the course. No refund will be made.

9. Delegate Suitability
It is the responsibility of the customer and the delegate to ensure that the delegate has the required prerequisites to attend the course and ensure that the delegate is suitable to attend. The delegate must agree that they have read and understood the course outline and meet the requirements. Should the delegate not be suitable for the course in NIO Training Ltd.’s opinion, the customer is liable for the full payment of the course and no refund will be given.
10. Training and Assessment
NIO Training Ltd are an accredited training provider. If NIO Training Ltd in its opinion, believes that the delegate hasn’t met the required standard required to pass the course, the certification will not be provided. Full payment is still due, and no refund will be given. Certification will be withheld because of an unpaid invoice until outstanding debt is paid (including any interest due).

11. Equality and Diversity
If a delegate needs a reasonable adjustment because of a disability, please notify NIO Training Ltd at the time of booking or at least 14 days prior to the course. Please email contact@niotraining.com with the information regarding the delegate. NIO Training Ltd will confirm in writing whether the adjustment can be accommodated. Any information given will be kept confidential. If NIO Training Ltd is not informed of any reasonable adjustments at least 14 days prior to the course, NIO Training may not be able to accommodate or make the adjustments needed, as such full payment will still be due, and no refund will be given.

12. Customer Obligations
Where NIO Training Ltd provide services at the customers premises, the customer shall:
​
i. provide NIO Training Ltd and its representatives access to the customers premises and facilities reasonably required by NIO Training Ltd
​
ii. when required, prepare the customers venue for the course as needed by NIO Training Ltd.
​
iii. when applicable, obtain all necessary licences, permissions and consents which may be needed for the provision of the course
​
iv. store all equipment, materials documents and other property of NIO Training Ltd in a safe and secure place on the customers premises at the owners on liability and risk and returned in good condition to NIO Training Ltd at the end of the course in a timely manner.

If NIO Training Ltd is prevented or delayed from carrying out the course or service it’s providing or the customer fails to perform its obligations, NIO Training Ltd reserve the right, without limiting or affecting any other right, to delay or suspend performance of the course/service until the customer remedies the situation satisfactorily. NIO Training Ltd shall not be liable for any costs or losses sustained or incurred by the customer arising directly or indirectly from NIO Training Ltd failure or delay to provide the course/service. The customer shall reimburse NIO Training Ltd on demand for any costs or losses sustained or incurred by NIO Training Ltd arising from directly or indirectly from the customer default.

13. Personal Protective Equipment, Tools and Equipment needs
It is the responsibility of the customer to ensure that the delegate has the correct personal protective equipment (PPE), specialist tools, plant and equipment required for the course. It is the customer's responsibility to ensure that the items are fit for use and in good condition. If the customer fails to provide such tools and equipment, the course/service maybe abandoned, and the customer will be liable for the full cost of the course/service. No refunded will be given.
14. Health and Safety
The health and safety of the delegate whilst on site is of the utmost importance. An H&S induction will be given to all delegates. Failure to adhere to the site health and safety requirements may result in the delegate being asked to leave. If that happens, no refunded will be given. NIO Training Ltd has a no smoking policy on its premises. Smoking breaks will be limited.

15. Customer Complaints
In the event that a customer has a complaint or claim in respect of a course or service provided by NIO Training Ltd, they shall put their complaint or claim in writing within 48 hours of the completion of the course/service provided. NIO Training Ltd shall have no liability for the course/service provided. When a complaint is raised, NIO Training Ltd will endeavour to respond in 48 hours. Please refer to the complaints policy for further information.

16. Governing Law
The agreement for the provision of services by NIO Training Ltd and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with the law of England and Wales.

17. Force Majeure
NIO Training Ltd shall not be in breach of the agreement for provision of services to the Customer nor liable for delay in performing, or failure to perform, any of its obligations under the agreement if such delay or failure result from events, circumstances or causes beyond its reasonable control.
​
18. Jurisdiction
Each party agrees that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with the agreement for the provision of services by NIO Training Ltd or its subject matter or formation. I, the Customer confirm that I have read these terms and conditions and by signing below, I confirm that I understand each term and condition and that these Terms and Conditions are applicable to the services supplied by NIO Training Ltd.

NIO Training Ltd reserves the right to amend or change these terms and conditions at any time.
